根据《全国人民代表大会常务委员会关于专利等知识产权案件诉讼程序若干问题的决定》《最高人民法院关于知识产权法庭若干问题的规定》，最高人民法院设立知识产权法庭。
现将有关事项公告如下：
一、最高人民法院知识产权法庭自2019年1月1日起履行法定职责。
二、依照《中华人民共和国民事诉讼法》《中华人民共和国行政诉讼法》《全国人民代表大会常务委员会关于专利等知识产权案件诉讼程序若干问题的决定》《最高人民法院关于知识产权法庭若干问题的规定》等法律和司法解释的规定，最高人民法院知识产权法庭主要审理专利等专业技术性较强的知识产权民事和行政上诉案件。
三、《最高人民法院关于知识产权法庭若干问题的规定》第二条所称第一审案件的判决、裁定或者决定，于2019年1月1日前作出，当事人依法提起上诉或者申请复议的，由原审人民法院的上一级人民法院审理；于2019年1月1日以后作出，当事人依法提起上诉或者申请复议的，由最高人民法院知识产权法庭审理。
四、当事人向最高人民法院知识产权法庭提起上诉的，依照《中华人民共和国民事诉讼法》《中华人民共和国行政诉讼法》的规定，上诉状应当通过原审人民法院递交。

Announcement
According to the Decision of the Standing Committee of the National People’s Congress on Several Issues Concerning Judicial Procedures for Patent and Other Intellectual Property Cases, and the Provisions on Several Issues Concerning the Intellectual Property Court of the Supreme People’s Court, the Intellectual Property Court of the Supreme People’s Court is established. Relevant matters are hereby announced as follows:
1.The Intellectual Property Court of the Supreme People’s Court shall perform its statutory duties from January 1, 2019.
2.In accordance with the provisions of laws and judicial interpretations such as the Civil Procedure Law of the People’s Republic of China, the Administrative Procedure Law of the People’s Republic of China, the Decision of the Standing Committee of the National People’s Congress on Several Issues Concerning Litigation Procedure of Patent and Other Intellectual Property Cases, and the Provisions on Several Issues Concerning the Intellectual Property Court of the Supreme People’s Court, the Intellectual Property Court of the Supreme People’s Court shall try try the patent and other professional and technology involved Intellectual Property cases on appeal throughout the country.
3.To the judgments, orders or decisions of the first instance cases referred to in Article II of the Provisions on Several Issues Concerning the Intellectual Property Court of the Supreme People’s Court made before January 1, 2019, if the party concerned file an appeal or apply for a review according to law, the case shall be tried by the people’s court at the higher level of the first instance people’s court; To the judgments, orders or decisions made after January 1, 2019, if the party concerned file an appeal or apply for a review, the case shall be tried by the Intellectual Property Court of the Supreme People’s Court.
4.If a party appeals to the Intellectual Property Court of the Supreme People’s Court, the petition for appeal shall be submitted by the people’s court of the first instance in accordance with the provisions of the Civil Procedure Law of the People’s Republic of China or the Administrative Procedure Law of the People’s Republic of China.
